Global Traffic Technologies Awarded Default Judgment in U.S. Patent Suit

Court Rejects Motion from Tomar Electronics

January 30, 2008 - ST. PAUL, Minn.--Global Traffic Technologies (GTT) has won a default judgment of infringement in its U.S. Patent infringement lawsuit against Tomar Electronics, Gilbert, Ariz. U.S. District Court Judge Michael J. Davis issued the ruling in Minneapolis on Dec. 27, 2007. The lawsuit involves GTT's traffic signal preemption technology, marketed under the name OpticomT Infrared Systems, and Tomar's Strobecom® II System.

The impact of the court's ruling is that Tomar has been found to infringe multiple claims of GTT's U.S. Patent No. 5,172,113. Additional proceedings will be scheduled to address the issue of remedy, including damages and an injunction. A copy of the judgment can be found at

Cash For Structured Settlements

I keep seeing many ads from several companies that talk about cash for structured settlements. It seems to make sense that if you have some kind of judgements or settlement that will be paying you slowly over time, that you want to get all of it now and not have to wait.

But I wonder what the cost for selling to a structure settlement broker is? Since there are so many ads, I have to think that people will take a LOT less cash if they don't have to wait for their money. So I'm not so sure that's really a good idea. It might make more sense to get a loan from a bank or someplace else and pay a lower percentage rate.

Health Courts Fail to Provide Medical Malpractice Protection

So-called 'Health Courts' Fail to Provide Adequate Protection for Those Victimized by Medical Malpractice

Attorney Jeffrey Hensley says the health courts, supported by the AMA, "are like having the fox guard the henhouse."

Palm Harbor, Fla. - July 13, 2007 -- So-called "health courts," which would replace juries with health care professionals in medical malpractice cases, would leave malpractice victims dangerously unprotected, Attorney Jeffrey Hensley said today.

The American Medical Association (AMA) adopted principles earlier this month that favor the health courts, which would do away with peer-based juries and replace them with judges trained in
medical standards.

Hensley said the notion of health courts dangerously tips the standard of justice in malpractice cases against victims who may be entitled to sizeable judgments when they are seriously harmed by poor medical care.

"There is a fox-guarding-the-henhouse quality to this idea of having medical people passing judgment in
medical malpractice cases," Hensley said. "People who have suffered very serious injuries or damages as a result of medical malpractice should have little confidence in courts which are run by the very same profession that caused their injuries."

Instead, Hensley said, medical malpractice victims should have full access to a court system in which their peers consider evidence from both sides, and then determine possible damages that are based fairly on the extent of their
injuries or damages.

"This is not simply a step away from reasonable
medical malpractice law," Hensley said. "This is a step away from the very foundations of American justice."

So-called health courts were conceived during Brookings Institute conferences in 2002 and 2003. Besides the move to health courts, the principles adopted by the AMA urge quick resolution of claims,
special training for judges, and reliance on qualified experts. The AMA also has stated its support for limits, or caps, on medical malpractice judgments.

A better way to limit malpractice judgments, Hensley said, would be to limit
substandard medical treatment that results in injury or even death.

"If the AMA wants to limit the claims that get awarded in medical malpractice suits, a good place to start would be in its own backyard," Hensley said. "People have a right to expect good,
professional health care and, when they don't receive it, they should have a right to reasonable financial claims."

Hensley said it is important to remember that the duty of a
medical professional is not to cure, or even to guarantee a good outcome from treatment. Rather, the duty is to provide good medical care according to accepted standards in the community, or, in the case of a specialist, accepted standards in that medical specialty.

"Medicine is not an exact science, and doctors are not required to be right every time they make a diagnosis," Hensley said. "A misdiagnosis becomes malpractice, however, if the doctor fails to get a
medical history, order the appropriate tests, or recognize observable symptoms of the illness."

Saving Money Can Kill You

I didn't realize that "Save money. Live better." was Wal-Mart's trademarked motto until I went to their web site the other day. This was just after I read an article by security expert J.R. Roberts (Disclaimer: Roberts is one of our clients) that seems to explain why sites like http://www.WalMartCrimeReport.com/ and others have appeared. Saving money is great, but it does not always go together with living better.

Target: Wal-Mart 
describes an interview Mr. Roberts had with an inmate convicted of raping and murdering a woman in a Walmart parking lot. With a long criminal history, the killer preferred Wal-Mart parking lots for one simple and now obvious reason: No security. It seems that to make the parking lots safe for customers and staff in Florida in 1994 would cost "...Wal-Mart $45,000.00 dollars per year per store."

Well, I have a suggestion for Wal-Mart that may be useful: Get rid of the useless "greeter" that accosts you when you enter the store. Instead, build a small building out in the parking lot. Not at the edge near the store, but in towards the center of the lot perhaps 10-20 parking spaces. Make this a remote customer service / security office and equip it with security cameras. Put more cameras in important lot locations and install remote alarms that can be use by customers if there is an emergency. And consider installing hidden cameras that can record the occupants of every vehicle that enters and leaves the parking lot.
 
If you want to not only make the parking lot more secure but also provide better customer service, you could allow customers to make simple product returns there and have a drive-up for buying small things like gift cards. For that matter, you could have a long covered walk-way and put his new building out near the center of the parking lot. It would give you more spots to mount cameras and also give customers a sheltered walk to the main building.
