Major Survey Research Trade Organization Cautions on Dangers in Using Routine Pharmaceutical Surveys as a Component of the “Pharmacovigilence” Process

Port Jefferson, NY (PRWEB) June 29, 2006 -- The Board of Directors of CASRO voted last week on issuing a statement to caution the pharmaceutical industry on requiring routine pharmaceutical surveys to report Adverse Events in the course of the research. The Board outlined in the statement the reasons for taking this position.

The Board statement follows:
CASRO believes that market research organizations should not be required to assume responsibility for formal reporting of adverse events (AE) uncovered in the course of routine pharmaceutical market research because it is not a methodologically sound approach to post-market surveillance and it exposes research organizations to unacceptable legal and ethical risk.

However, in the event that a research organization chooses to accept the responsibility of reporting AE, we urge that, at a minimum, the organization obtain contractual terms that:

(1) fully specify all the conditions and procedures associated with those adverse reporting requirements, including stipulations associated with collection of both qualitative and quantitative data, as well as procedures to be taken in the event that respondents refuse permission;

(2) endorse a policy by which respondents are informed at the start of the research that any mention of product dissatisfaction will require that the organization submit an AE report on their behalf if one has not already been filed;

(3) fully waive, and indemnify the market research organization against, any and all legal liabilities arising as a result of its AE reporting responsibilities.

While CASRO believes these terms extend some measure of legal protection to member organizations and help to safeguard the ethical integrity of the research process, they do not overcome CASRO's overriding concerns about the impracticality and inadvisability of requiring routine market research studies to serve as a direct instrument of the “pharmacovigilence” process.

CASRO believes that we, as an industry, are better-equipped to advance pharmacovigilence in a different way. Recognizing that the industry’s extensive contact with patients and physicians puts us in a unique position to encourage and facilitate AE reporting by those who experience them and the medical professionals who observe them, CASRO recommends that research organizations play an indirect role, by reminding respondents of the importance of AE reporting and providing them with information to help them do so.

The Lord Chancellor, Lord Falconer has announced changes to compensation laws which will mean victims of asbestos-related cancer will receive full compensation.

(PRWEB) June 27, 2006 -- The Lord Chancellor, Lord Falconer has announced changes to compensation laws which will mean victims of asbestos-related cancer will receive full compensation. The announcement follows the House of Lords ruling in Barker v Corus in May this year that prevented thousands of mesothelioma victims from receiving a full payout. The decision reduced the amount of compensation to which they were entitled when employers and their insurers were unavailable to be sued, as well as making the whole process of claiming compensation longer and more costly. In response The Lord Chancellor, Lord Falconer and John Hutton, the Work and Pensions Secretary, will amend the Compensation Bill - currently going through Parliament - to reverse the ruling. The amendment will mean that negligent employers will be jointly and severally liable and that claimants will be able to recover full compensation from any one employer.

Implanted Screwdriver Results in 5.6 Million Dollar Lawsuit: Why Hospitals are Turning to Airline Pilots to Prevent Poor OR Teamwork

A Hawaiian hospital could have saved a patient’s life, $5.6 million and a shockwave of negative publicity if they had invested in training their surgical teams to use the same assertive communication skills used by flight crews in commercial aviation.

Memphis, TN (PRWEB) June 26, 2006 -- The Institute of Medicine estimates that the total cost of medical errors in U.S. hospitals is an astonishing $17 billion a year. One horrific case of a medical error involved a patient who had the steel shaft of a screwdriver surgically implanted into his spine.

Despite the concerns of the nurses on his surgical team, the surgeon used the screwdriver in place of two titanium rods that turned up missing from the OR when the surgeon needed them. Not wanting to wait, he instead decided to use the screwdriver shaft.

To avoid these sorts of decision-making errors and empower nurses on the surgical team to effectively intervene when needed, many hospitals are implementing the aviation-based safety protocols and assertive communication techniques used by commercial flight crews.

One innovative aviation-based safety system, developed by the airline pilots, NASA astronauts, and active physicians of LifeWings Partners LLC, has been implemented in over 40 healthcare facilities nationwide. Florida Litigation Attorney Don Conwell Successfully Defends Hooters Rival Ker’s Winghouse in Lawsuit Appeal filed by the Hooters Restaurant Chain.

Tampa, Florida (PRWEB) June 20, 2006 -- Ker’s Winghouse, a fast growing restaurant chain founded by former NFL Dallas Cowboys football star, Crawford Ker, defeated Hooters’ trade dress infringement lawsuit appeal last week, winning more than one million dollars in counterclaim damages against the prominent restaurant chain (In the United States Court of Appeals for the Eleventh Circuit D.C Docket Number: 03-00116-CV-ORL-22-JGG).

Hooters’ appeal repeated allegations made by Hooters in its failed lawsuit against Ker’s Winghouse in the United States District Court that Ker’s Winghouse—whose female wait staff also wear short shorts and tank tops —unfairly copied proprietary elements from the “Hooters Girl” and from Hooters restaurant décor.    

The decision by United States Circuit Court Judge Rosemary Barkett rejected Hooters’ appeal, stating “Hooters’ trade dress infringement and dilution claims fail as a matter of law.”

Ker’s Winghouse was represented in both the trial and appellate courts by Florida litigation lawyer Don Conwell of Conwell, Sukhia and Kirkpatrick, which partnered with the Tampa based law firm of Fowler White Boggs Banker to successfully defend Ker’s Winghouse.     The appellate court’s written opinion affirming the judgment for Ker’s Winghouse in the trial court came quickly, only seven days after Conwell argued the appeal before the appellate court panel of judges.

“This is a great day for our client, which can now continue its head to head competition with Hooters in the market place, free of the threat of oppressive litigation,” said attorney for Ker’s Winghouse, Don Conwell.

The litigation by Hooters against Ker’s Winghouse has been in the courts for several years. The case was tried in federal court in Orlando, Florida in November, 2004. In December, 2004, United States District Court Judge Anne Conway rejected Hooters’ trade dress infringement lawsuit claims and awarded $1.2 million in counterclaim damages to Ker’s Winghouse on a jury verdict in favor of Ker. Judge Conway adopted the arguments of Florida attorney Don Conwell that Hooters did not have protectable trade dress and that the trade dress of Ker’s Winghouse was not likely to confuse consumers.

After that verdict, Conwell stated, “The directed verdict and jury award completely vindicate Winghouse’s position that Hooters was using its wealth and muscle in the courts to try to unfairly exclude legitimate competition.”

The lawsuit has been considered a significant case in intellectual property litigation and has received national televised attention with coverage on MSNBC and numerous other local and national press outlets.

California Consumers File Class Action Against Great Seneca Financial Corp. and Wolpoff & Abramson for Alleged Unfair and Fraudulent Debt Collection Practices

Two California consumers, Shane Satey and Kenneth Holtzclaw, have brought a class action against Great Seneca Financial Corp. and the debt collection law firm of Wolpoff & Abramson, alleging unfair and fraudulent debt collection and credit reporting practices and also that Great Seneca was collecting debts in California for months without being properly registered as a California corporation. La Crescenta, CA (PRWEB) June 20, 2006 -- Two California consumers, Shane Satey and Kenneth Holtzclaw, have brought a class action against Great Seneca Financial Corp. and the debt collection law firm of Wolpoff & Abramson, alleging unfair and fraudulent debt collection and credit reporting practices and also that Great Seneca was collecting debts in California for months without being properly registered as a California corporation. For at least several months, nationwide debt collector Great Seneca Financial Corp. allegedly collected debts in California without being licensed to do business here. Hundreds, even thousands, of California consumers who paid money to Great Seneca to settle debts may be entitled to relief.

The story began with Shane Satey, a Southern California resident and a victim of identity theft. An identity thief stole Mr. Satey’s Chase credit card information and used it to charge up over $8,000 at a local retailer in Glendale. Although Mr. Satey sent a copy of the police report to Chase, Chase credit-reported the alleged debt and also sold it to debt collectors. In late 2005, debt collector Great Seneca purchased the debt and sued Mr. Satey, who hired the La Crescenta consumer protection firm Brennan, Wiener & Associates to obtain justice for the identity theft. On the very day when Brennan, Wiener & Associates contacted Great Seneca’s attorneys, Wolpoff & Abramson, Great Seneca mysteriously dismissed the case without comment.

A few months later, Great Seneca sued Kenneth Holtzclaw on an alleged debt which was many years older than the four-year limitations period for collecting debts in California. Seeking information about his rights, Mr. Holtzclaw coincidentally contacted Brennan, Wiener & Associates. Brennan, Wiener & Associates learned that Great Seneca was not licensed or registered as a California corporation, so Brennan, Wiener & Associates filed an answer and cross-complaint against Great Seneca and Wolpoff & Abramson. Suddenly, Great Seneca became properly registered as a California corporation on April 10, 2006, although it had been collecting debts in California for several months before then.

Mr. Holtzclaw and Mr. Satey have filed a class action in Los Angeles Superior Court against Great Seneca and Wolpoff & Abramson for alleged unfair and fraudulent debt collection practices. Holtzclaw/Satey vs. Great Seneca Financial Corp., et al., Case No. 06 E 02709.

“Their conduct was no accident,” commented lead class action counsel Robert F. Brennan of Brennan, Wiener & Assoc. “By not properly registering itself as a corporation, Great Seneca avoided paying taxes and other fees that it would have paid had it properly registered with the State of California. Even more important, Great Seneca was insulating itself from any kind of cross-complaint for unfair debt collection practices or unfair credit reporting because it had no agent for service of process in California.” Mr. Brennan also commented on the relationship with the Wolpoff & Abramson law firm. “As far as we can tell, Wolpoff & Abramson and Great Seneca are two peas in a pod. Our preliminary research suggests that Wolpoff & Abramson set up Great Seneca just to try to insulate itself from unfair debt collection lawsuits. For licensed attorneys to be collecting upon thousands of consumer debts through an unregistered corporation is positively inexcusable. One, two, maybe half a dozen instances is one thing, but here we have several months of such collection practices. I cannot believe Wolpoff & Abramson did not know that Great Seneca was not properly licensed and registered in California.”

The class action seeks damages for the class members as well as an injunction that Great Seneca repay the State of California any penalties, taxes or fees it should have paid when it first began collecting debts in California as an unlicensed corporation. Further, Mr. Brennan states that he will request that the court compel Wolpoff & Abramson to publicly disclose the full nature of its relationship with Great Seneca.

Brennan offers a few tips to consumers being pursued or harassed by debt collectors: “First, know your rights under the Fair Debt Collection Practices Act and its California counterpart, the Rosenthal Fair Debt Collection Practices Act. These laws can be found on the internet. If you have any doubts whatsoever about the company trying to collect from you, contact the California Secretary of State and check into the company’s status. The California Secretary of State also sometimes has other information about debt collectors, as does the Federal Trade Commission. You’d sometimes be surprised what you find out.” The Federal Trade Commission has a website at

Federal Trade Commission Releases Favorable Opinion On Client-Attorney Matching Services

Online legal matching services described as having potential cost savings for consumers seeking information on the price and quality of legal services.

San Francisco, CA (PRWEB) June 11, 2006 -- The Federal Trade Commission recently released its position regarding the great potential of online legal matching services to benefit consumers seeking legal counsel. The FTC determined that online legal matching services, which help consumers find legal representation, have the potential to lower the costs of obtaining information about the price and quality of legal services.

In a seven page letter dated May 26, 2006, from the FTC Office of Policy Planning, Bureau of Competition, and Bureau of Economics, the committee wrote to the Professional Ethics Committee of the Texas State Bar giving their opinion on whether or not it is ethical for Texas attorneys to participate in online legal matching services. Bar Association Ethical Rule 7.03 prohibits lawyers from paying a non-lawyer to solicit clients, except for paying normal advertising fees. The question at hand was: Does Rule 7.03 also prohibit lawyers from participating in online legal matching services? The opinion of the FTC, supported by three different internal departments and agreed to by a unanimous vote of commission members, is “No, it does not.”

According to Laurie Ziffrin, CEO of LegalMatch, the nation’s leading online legal matching service, “This opinion is not only good for Texas consumers but good for everyone in the US who might need an attorney. The FTC believes that online legal matching is a valuable option for Texans as it would likely reduce legal costs. This opinion will resonate with bar associations nationwide.”

Professional services have long struggled with the ethics behind advertising and marketing their services. The Bates vs. State Bar of Arizona decision by the Supreme Court in 1977 allowed attorneys to market themselves proactively. From then on, Bar Associations and individual attorneys alike have had difficulty on deciding where to draw the line. With this opinion, the question has been made easier to answer.

The bar associations of North Carolina and South Carolina, and the Rhode Island Supreme Court have already issued ethics opinions explicitly allowing online legal matching services to operate. And, the Utah State Bar has partnered with LegalMatch to help those seeking legal assistance access pre-screened Utah lawyers.

The Colorado Court of Appeals today affirmed the verdict in the case of Aloi v. Union Pacific R.R., with a verdict in the amount of six-million dollars.

Denver, CO (PRWEB) June 10, 2006 -- The Colorado Court of Appeals today affirmed the verdict in the case of Aloi v. Union Pacific R.R., with a verdict in the amount of six-million dollars.

The case ultimately reached the Colorado Supreme Court on the issue of destruction of evidence (Supreme Court, State of Colorado, Case No. 04SC320.) The Supreme Court found that the trial court had acted appropriately in instructing the jury with respect to the UP’s destruction of evidence, and remanded the case back to the Colorado Court of Appeals, which today affirmed the district court’s original verdict. With interest the amount owed is approximately $7.5 million, growing at a rate of $1,500 per day.

Frank Aloi was injured in the course of his work as a UP conductor in North Platte, Nebraska. A piece of defective rubber matting on a locomotive’s steps caused Mr. Aloi to fall down the stairs, crashing head long into the door, sustaining serious injuries to his head, neck, back and shoulder. Ultimately, these injuries required three surgeries (low back, right knee, and right shoulder). Mr. Aloi also suffered a traumatic brain injury in the fall.

The case was handled by Lou Jungbauer of Yaeger, Jungbauer and Barczak, a law firm with offices in Denver, Minneapolis, and St. Louis. Jungbauer contended that the UP had been negligent in violation of the Federal Employees Liability Act (FELA), and had violated the Locomotive Inspection Act, (a federal safety statute which requires railroads to keep their locomotives in a safe condition), as well as federal safety regulations which require the railroad to keep its locomotive floors and walkways free from tripping hazards.

The UP denied responsibility, noting that the fall was unwitnessed, claiming that it could not have happened as alleged, and arguing that Mr. Aloi was exaggerating his injuries.

The Yaeger team conducted a thorough investigation, which revealed that an inspection report had been completed after the accident, confirming the defective matting.

When YJB requested this report, and other inspection and maintenance reports, the UP was unable to produce them. Jungbauer brought this to the court’s attention, arguing that because the UP had a legal duty not to discard or destroy relevant evidence, the judge should allow a jury instruction on the matter. The judge agreed and gave the instruction.

The UP’s appeal was based in large part on that special jury instruction. The Colorado Supreme Court decision found that in giving the instruction the district court did not abuse its discretion.

Upon hearing today’s decision Frank Aloi, the plaintiff, made the comment: "This case is more about justice than money."

1. Stop everything and offer help to anyone who appears to need it.
Whether you are in a work-related accident or a car accident, no matter who is at fault, the first priority is always to take care of those who may have been injured. You may lightly cover them with a blanket, but avoid jostling them, as it can cause further damage.
 
2. Call for help right away.

At the early stages, assigning blame will not likely do you any good and may make the situation far more unpleasant than it has to be.
 
5. Start keeping a paper trail.
Write down your impressions and memories of the accident as soon as you have a spare minute. Keep a journal of any effects you suffer from the accident and keep your proof as well as your records in one file. This file may be invaluable if you seek help in court.
 
6. Seek medical attention
If you've been injured, no matter how slightly, be sure to visit a hospital or doctor right away. Ask your doctor to gather evidence -- including statements, photographs, x-rays, and other materials. This can help you make a claim later on and can help prevent lawsuits against yourself. You may need to sign a release form to ensure that your medical information is available to your investigator or your insurance company.
 
7. Contact all appropriate parties
Once you have been released from the hospital and are back at home, make sure that you contact your insurance company, employer, friends and family, and anyone else you need to contact let them know but the accident. Be sure to continue to cooperate with police, law enforcement, and your insurance company to resolve the matter. If it seems as though the situation is not being resolved to your liking, consider a lawyer or private investigator to protect your interests. Investigator Warns Consumers on Lookup Scams

PI warns web surfers to avoid fraudulent database and subscription-based skip tracing companies. Ads claiming the ability to locate information via database or subscription service are misleading at best, says Cellulartrace.com CEO Mark McAlpin.

(PRWEB) June 9, 2006 -- Web scams and gimmicks aren’t just reserved to the popular Nigerian Bank account grift, according to investigative company CEO. Cellulartrace.com executive Mark McAlpin issued a warning to consumers Wednesday stating that the bulk of CPC advertisers were not being forthright with the information they were promising consumers.

“When searching the web for a reverse lookup, phone search or email address trace, people are inundated with ads promising such services via database or subscription. In reality they are paying money to search an outdated collectioin of info or purchase a subscription to these "data-less bases." It is fraud of the highest order. People are being led to believe they are getting current information when they are really getting nothing useful at all.” McAlpin stated on the company’s website.

After the media buzz surrounding call records earlier this year, McAlpin says scores of companies or, as he suspects, “the same few companies” replicated with new names wanted to cash in on the popularity of investigative web services. While his attitude seems easy to dismiss as simply opposing the competition, he insists that has nothing to do with it.

“I’m the biggest free-market supporter you’ll find. I welcome competition. If someone thinks they can offer accurate phone searches for less than we can, go ahead—let the market decide. But promising someone a reverse lookup search, taking their money and offering them database rubbish or linking them to another pay site isn’t competitive commerce, it’s fraud.”

He also noted that several companies claiming to perform the type of skip tracing phone search services his company does actually link back to the Cellulartrace.com website after the customer has entered the phone number and paid, creating the illusion that they are somehow affiliated with his site.

McAlpin has a valid point. When we Googled reverse lookup, five of the six sponsored ads were to companies offering database-style searches. As there is no cellular phone number directory, it is difficult to imagine the legitimacy of such offerings. Still, in the interest of fairness we tried three of them.

The first took presented us with an input box, where the number to be searched was entered. After a dramatic pause we were told the info was found. To see it, we had to pay—fair enough. $49 later we were redirected to the reverse lookup searches page of McAlpin’s website.

McAlpin just shook his head. “That’s what these people do. They take your money and pawn you off on someone else. We get a few cancellation requests a day from these company’s customers as they think we have some affiliation with these grifters.”

The other two services also claimed to have found info on the number entered. This time, a subscription for “unlimited” searches had to be purchased. After the money changed hads and the “account” opened, there was suddenly no record of the number. We tried another and another—same result. Finally we entered a few business numbers which the database had. In fact the only numbers the reverse lookup service had seemed to be listed numbers available for free on any number of websites like Infospace.com or AT&T’s AnyWho.com.

“We’d love to have people’s business,” McAlpin admitted. “But more important to the industry and the web is that people are careful not to be taken by cheap promises and empty wording. People need to remember, there is no database for cell numbers or unpublished numbers. Anyone claiming otherwise should be assumed a hustler.”

McAlpin says it is important to realize that there are several legitimate databases available to investigators and such companies are not the target of his ire. His warnings only apply to companies advertising to the public and not selling what they claim.

The Cellulartrace.com website, which offers phone number searches on cellular numbers only, has a series of articles on the fraudulent nature of many cost-per-click advertisers. The series is to conclude with a final piece on 6/21/06.

The study has approximately 300 tables of data summarizing a broad range of developments in law library policies regarding personnel and salaries, materials spending, procurement, management, reference services, and information policy.

The study presents data from a survey of 84 law libraries; data is broken out for law firm, university, government and private company law libraries, and by size of the library’s content budget. The study has approximately 300 tables of data summarizing a broad range of developments in law library policies regarding personnel and salaries, materials spending, procurement, management, reference services, and information policy. Just a few of the study’s finding are that:

•    Close to half of the libraries in the sample have decreased the size of the library within the past five years, and more than half of the law firm libraries have done so. Both small and large libraries have tended to decrease their size.
•    More than 70% of the law libraries in the sample increased their budgets in 2005 and only a shade more than 3% decreased their budgets.
•    Sixty five percent (65%) of the law libraries in the sample expected their budgets to increase in 2006, while only 8.33% expected a decrease.

Law Library spending for contents and materials:
•    The libraries in the sample spent a mean of $561,537 for online databases in 2005. One library spent nearly $7.5 million. The law firm libraries in the sample spent by far the most, spending a mean of $1,036,920.
•    Perhaps surprisingly, expenditures on print resources still account for more than half of the materials/content spending for the libraries in the sample. Only law firm and private company law libraries spend less than half of their content/materials budgets for print resources.

Reference and research policies
•    About half of the libraries in the sample keep a written log of the reference questions that they receive. University law libraries are the most apt to keep written logs, while government libraries were the least likely.
•    Overall, less than 8% of the libraries in the sample say that intellectual property issues are involved in as much as 30% of the library’s research. Indeed, for more than half of the libraries in the sample intellectual property issues are involved in less than 5% of library research projects.
•    For about 70% of the libraries in the sample, questions involving mergers & acquisitions were involved in 5% or fewer of their research projects. As might be expected, law firm and private company law libraries were the most likely to be concerned with mergers and acquisitions as a primary research theme.
•    The law librarians in the sample spent a mean of 4.23 hours online per day, a figure that is generally and surprisingly low for knowledge workers in highly information intensive industries. Print still matters in the law library world, much more so than in the general corporate library world.

Blogs, Listservs and RSS feeds
•    The librarians in the sample spent a mean of 3.93 hours per week reading blogs and listservs.
•    Librarians in the sample traveled away from their offices on library business a mean of 7.67 times in the past year (the median was 4.0). Librarians from law firms traveled more frequently than other law librarians, a mean of more than ten times per year, and university law librarians traveled the least, a mean of 3.75 times per year.

Content and knowledge management
•    Close to half of the law libraries in the sample have parent organizations that have content management systems through which case materials are scanned and made available to attorneys in digital formats
•    Spending on print reporters by the libraries in the sample fell in 2006, with mean spending dropping from $34,815 to $32,819, or by 5.73%. Spending by law firm libraries fell to $40,172 from $46,061, or by 12.8%.

Workstations in the library
•    Workstations from Dell were the most commonly used among the major computer manufacturers. More than 40% of the libraries in the sample used Dell workstations.

Use of jobbers and subscription agents
•    Close to half of the libraries in the sample used a subscription agent to obtain periodicals, though less than half of the law firm libraries in the sample did so and less than forty percent of the government law libraries did so.
•    Less than 9% of law firm libraries use book agents or “jobbers” to obtain their books.

Continuing education for attorneys
•    The libraries in the sample spent a mean of $7,878 annually on continuing and degree-related education for the library staff. Law firm libraries spent the most, a mean of $12,510, and one law firm library spent as much as $100,000.

Internet serach skills of attorneys
•    Most librarians in the sample characterized the internet search skills of the attorneys in their organizations as “Average” but only a shade more than 17% considered them “Proficient” or “Highly Proficient.”

Believed to be the first time a Harris County judge rules that Section 41.0105 of the Texas Civil Practice and Remedies Code applies to limit a Party’s recovery of medical bills. Benavides v Zurich American Insurance Company.

Dallas, TX (PRWEB) June 8, 2006 -- On May 30, 2006, Hermes Sargent Bates attorneys Anthony Cox and Greta Matzen obtained a summary judgment of damages, stating that Section 41.0105 of the Texas Civil Practice and Remedies Code limits a Party’s recovery to the amount paid by a collateral source, such as workers' compensation. This is believed to be the first time a Harris County judge has decided Section 41.0105 applies to limit a Party’s recovery of medical bills.

Section 41.0105 limits a Party’s recovery of medical expenses to those expenses that the Party actually “pays or incurs.” The claimant/plaintiff had sought to recover medical expenses for the amount the medical provider billed, despite that the Workers' Compensation Act reduced those bills under fee guidelines promulgated by the Workers' Compensation Commission.

In granting summary judgment, the court reasoned that just because a medical provider sends a bill does not mean that a Party is entitled to recover that amount. Of particular importance, the court determined Section 41.0105 did not limit the recovery of paid medical bills as a “collateral source,” but rather that the section applies as a substantive limitation on a Party’s damage claim. Program Helps Low-Income Working Build Financial Security

Community Savings Center Celebrates Grand Opening; Thrivent Financial for Lutherans Collaborates to Create Innovative Program Aimed at Helping Low-Income Working Individuals Build Financial Security

MINNEAPOLIS--(BUSINESS WIRE)--June 6, 2006--It's a first of its kind in Illinois and one of only a few in the country. The Community Savings Center on Chicago's west side celebrated a grand opening May 30 with a keynote address by Chicago Mayor Richard Daley.

Thrivent Financial for Lutherans contributed $2.6 million and collaborated with Bethel New Life Inc. and Park National Bank to create the Community Savings Center located at 310 N. Pulaski Road, Chicago. The Center, which opened in January 2006, brings together financial education, accessible and affordable financial products and a network of resources under one roof in order to help low-income working individuals achieve financial security.

"Thrivent Financial is thrilled our idea for this type of collaborative program has come to fruition," said Brad Hewitt, senior vice president of fraternal operations for Thrivent Financial. "Through the Community Savings Center, we are helping people learn how to manage their money, save and build good credit. Thrivent Financial is making a $2.6 million investment in this neighborhood's future because when people get ahead financially, the entire community benefits."

Specifically, Thrivent Financial contributed $1 million for an individual development account (IDA) program called $mart $avers. The program is co-run by Thrivent Financial and Bethel New Life Inc., a Lutheran non-profit agency that started the program in 2000 to help economically disadvantaged families save toward accumulating appreciable assets. The U.S. Department of Health and Human Services has matched Thrivent Financial's grant with a $1 million grant of its own. An additional $1.6 million will be contributed by Thrivent Financial for operational costs over the next five years.

"Clearly, we would not have been able to do this without our other allies - Park National Bank which opened a branch at the Community Savings Center and Thrivent Financial for Lutherans which is providing $2.6 million to fund the Center's educational programs and services," said Steven McCullough, CEO of Bethel New Life Inc.

$mart $avers, one program offered at the Community Savings Center, combines financial education with a 2:1 savings incentive. Participants are required to enroll in a financial education class to improve their money management skills. After completing the course, every dollar they save is matched. Savings can only be used to purchase a first home, start or expand a small business or finance a post-secondary education. Participation is generally limited to those with household incomes no greater than 200 percent of the poverty line, which equates to income below $40,000 a year for a family of four. Program participants who reach their maximum savings potential will save $2,000 and receive a $4,000 match over the course of a 36-month savings period. If fully utilized, the $2 million in total grants should enable the purchase of 200 new homes, post-secondary education for 120 participants and investments in 60 small businesses.

In its first four months of operation, more than 100 people enrolled in the $mart $avers program have finished the required financial education classes and saved more than $7,600 resulting in $22,800 after the 2:1 match.

Southern California School Sued for Silencing Student on Illegal Immigration

The law firm of Lively, Ackerman & Cowles has sued California's Jurupa Unified School District for silencing a student who attempted to speak out on the issue of illegal immigration in a peaceful way.

Riverside, CA (PRWEB) June 5, 2006 -- The public interest firm of Lively, Ackerman & Cowles (www.LivelyAckerman.com) filed suit on behalf of Jurupa Valley High School student Joshua Denhalter late last week. The First Amendment suit alleges that the public high school has intentionally interfered with his right to speak out on the issue of illegal immigration. Case Number RIC450811 was filed in Riverside County Superior Court.

Mr. Denhalter alleges that on March 27, 2006, dozens of high school students, mostly of Mexican-American descent, illegally walked out of school in protest of legislation that was being proposed by the U.S. Congress (HR4437) concerning illegal immigration. He was not one of these students and chose to act lawfully.

Instead of illegally walking out of school and being truant, Denhalter chose to organize a legitimate and lawful counter-protest/assembly during the lunch hour on or about March 30, 2006. The peaceable assembly was to take place across from the school on a public sidewalk (i.e., a traditional public forum).

The peaceable assembly would not have disrupted school activities because Jurupa Valley High School has an “open lunch” period. This means that students are free to come and go during this time. As such, any student could have “walked out” during the lunch to attend the assembly and there would be no disruption or violation of truancy laws.

On the morning of March 30, 2006, Denhalter began handing out flyers for his event. That same morning, around 7:30 AM, he was approached by school officials and told that he could not hand out flyers advertising his First Amendment protected activities. He refused to give up his right to pass out handbills/flyers. As a result of his refusal to give up his constitutional rights, Denhalter was suspended for “handing out flyers (before school) advocating the disruption of school activities”. However, the school did not punish the dozens of students who walked out in violation of the law several days before.

Furthermore, between March 27 and March 30, 2006, the school allowed MECHA to sponsor an on-campus rally in opposition to HR4437. Denhalter asked for permission to sponsor a similar counter-rally on campus but was flatly denied by the school district's board.

Finally, just the week before filing of this complaint, on May 25, 2006, the school prohibited Denhalter from wearing a “Save Our State” t-shirt by telling him that he needed to turn the shirt inside out and not ever wear it again. The content of the political speech set forth on the shirt was the sole basis for this censorship and prior restraint of Denhalter’s rights. He seeks a restraining order allowing him to express himself freely as to political matters until the end of the school year (i.e., June 21, 2006).

According to lead attorney Richard D. Ackerman, “This is one of the worst governmental censorship cases I have seen in over a decade of practice. It is simply unbelievable that a school district would take sides with those who promote illegal activity over a student wishing to express his protected views in a traditionally and legally acceptable manner. "Making customers an offer they can’t refuse is the key to not having our technology become used as spam. Otherwise it might be outlawed. Customers are not looking to save 5 cents, but if they are buying a house and you can give them a better house for $100,000 less, the call may not be viewed as spam. Having the patents will enable a responsible advertiser to control and build the market," Donald Spector explains.

"We are looking for the right company to partner with. We have holdings in Microsoft and Time Warner, but we are speaking to companies that are willing to work with us," he continued. Spector says he was disappointed when Microsoft didn’t purchase AOL last year instead of giving the dividend to shareholders, but it is not the first time I read the tea leaves wrong.

Donald Spector, who is also Chairman of the Board of Trustees of New York College of Health Professions, has licensed hundreds of products to Fortune 500 companies and thinks the right partner is the key. "The money is not the most important thing; the most important thing is making sure the product does well. Win/Win situations are the only ones that grow the companies," says Spector.

"The fight for the Internet and the peripherals has just begun. Those that say it is over have little vision. Innovation Fund is working on providing early learning to children so that we can narrow the digital divide, as well as provide partial verbal communication so that patients can communicate better with health providers. Recent growth has been fueled by improvements made to the site in response to suggestions made by site members and legal bloggers. Rempel explains: "As a result of these changes, the site now focuses more on eliciting information that is relevant to its members. For example, the personal profile category that formerly asked about the member's religion now asks for a practice area instead, and the 'favorite movies' category has been changed to 'education/accomplishments.'"

But Lawbby.com is not intended to compete with LinkedIn, another networking site that focuses on career and business opportunities. "While those kinds of opportunities may arise from relationships started and nurtured on Lawbby.com," Rempel observed, "Lawbby.com is a more informal place for its members to socialize and build their relationships organically. This informality is reflected in the fact that any Lawbby member can contact another member, while on LinkedIn, introductions must generally be mediated by a mutual contact."

According to a recent article in Knowledge@Wharton, an online business journal published by the Wharton School of Business, social networking sites "are ingrained in Internet society . . . . The idea of joining online communities and being able to participate in them is not going to disappear."

How registered sexual offenders, pedophiles, convicted murderers and rapists exploit a loophole in the family law court system.

These small changes would have the added benefit of allowing families to recover faster from the divorce process than is now possible under the present system.

Ultimately these changes would also reduce the trauma, drama and devastation of divorce, minimize the number of valid court orders even provide for the use of such words as privacy and dignity in the divorce process. More immediate and pressing, these changes would act to protect and secure the safety of children.

Other changes would allow divorcing parties to control, for the first time who has what information and when during and after divorce just by reorganizing the court orders. By using the services developed by Custody Calculations, these changes and even more are now possible!

After spending many years on the front lines dealing with families, Catherine saw that the needs of families going through the divorce process were not being met. She sought answers. Research and development took ten years and included interviews both inside and outside the divorce process, business executives, judicial officers, and finance companies. She also reviewed issues related to workman's compensation and interviewed hospital emergency room staff, evaluators, mediators, school administrators, families and children, police officers, detectives, including specialized and non specialized police units. During development, data and research was further pursued using books, tapes, video recordings and other periodicals and documents from the fields of psychology, parenting, social services, and even included statistics on bankruptcy and other related issues.

In the process of research, Custody Calculations, obtained a broader view of the true impact of family law on our entire social system. The company identified issues like the fact that twenty five percent of all crime in this country may be related to family law, including, homicides, suicides, abduction, kidnap, child abuse, domestic abuse, violation of court orders. Most of this has gone unnoticed by the general public and those within the family law court system.

So what is the loophole and how does it work? The current process of filing for divorce requires no submission of a criminal history. Why is this an issue? Many women have no knowledge of the background and/or criminal history of the men they marry or have children with something that became clear during interviews with specialized police units who deal with registered sexual offenders, rapists and pedophiles.

According to the detectives and officers interviewed these predators seek out - women with young children whom they can abuse, or they have children with women with the specific intent to rape and abuse these infants and children- even their own biological children! The woman with whom they live or those they marry do not have this information, therefore they are unable to provide it to the court during the divorce and custody process. Family law court needs this information as part of making an “informed decision” for the safety and welfare of the children.

While a majority of the time it is women who are victims of sexual predators, men would benefit from the submission of criminal history by the other party. Men marry women who have criminal backgrounds of which they are unaware of as well. While women are more often guilty of prostitution, drug, and alcohol arrests there are a very small number of women who are sexual predators or women who have been arrested for severe neglect or abuse of their children. Again without this information, the court cannot make an “informed decision” for the protection, safety and welfare of children.

While on the surface, this change would appear to be overwhelming and would require new legislation, it could be done with a minimum of effort and would ensure the safety of children protecting them from abusers which can hardly be argued against.

Criminal records, testimony or lack thereof, would be submitted by the parties at the onset of the divorce process without further costs or burden to the courts and would be notarized. Verification of the name, date of birth etc could be confirmed against the document. The information would become a part of the court record, to be filed and referred to with the rest of the necessary disclosures when determining custody.
